PUBLIC HEARING & BOARD OF TRUSTEES MEETING
MINUTES AND ORDER OF BUSINESS


April 14, 2015 in the Public Library Memorial Room.

Present:
Elected Officers - Mayor Ronald A. Frohne II, Trustee Robin Moshier, Trustee Frances Hazelton, Trustee Warren Leonard, and Trustee Donna Walsh

Appointed Officers - Dayle A. Barra, Clerk & Harriett Geywits, Deputy Clerk/Treasurer

Public Hearing on Sewer Rate called to order at 6pm by Mayor Frohne, followed by the Pledge of Allegiance. No public comment. 

Motion to adjourn Public Hearing at 6:01 by Trustee Moshier, 2nd by Trustee Leonard – all voted yes. Motion carried.

Public Hearing on 2015-16 Tentative Budget called to order at 6:01pm by Mayor Frohne. No public comment.

Motion to adjourn Public Hearing at 6:02 by Trustee Leonard, 2nd by Trustee Walsh – all voted yes. Motion carried.

Fire Chief Hallock reported an open-burn ban issued by DEC and 14 air-packs needed in the coming year costing approximately $2500 each. Trustee Leonard asked that he try to get a quote for refurbished units, if available.

Douglas Bordinger informed the Board a Leak Specialist from NYRWA is coming to the WTP to assist with issues they’ve been battling in the last weeks.

Mr. Ron Crist asked the Board what measures are available to deter discharging firearms in the Village. The Mayor informed him they could post respective signs only on Village-owned property. Further discussion followed. 

Motion to approve minutes from 4/6/2015 by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes.

Deputy Clerk/Treasurer – Harriett Geywits

Ø  Continues to work with Engineers on fountain(s) repair preparations.

Clerk – Dayle Barra

Ø  Abstract #21 Funds: General $10,200.23, Water $5931.85, Sewer $10,097.12, Cemetery $100; total: $26,329.20. Motion to approve Abstract #21 by Trustee Leonard, 2nd by Trustee Hazelton – all voted yes.
Ø  March 2014 Clerk fees total $90.00.
Ø  Motion to approve issuing a fuel credit card in Doug Bordinger’s name for WTP use by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes.
Ø  Motion to implement Commercial Demolition Permit application with initial fee of $50 by Trustee Leonard, 2nd by Trustee Walsh – all voted yes.
Ø  Motion to adjust w/s account 45300 to reflect minimum sewer rate by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.
Ø  May 8, 2015 will be proclaimed as ‘Paint the County Purple’ day and the Lion’s Club sign will display such in Spring park during that week.
Ø  Property Maintenance invoices need to be looked into as to whether the administrative fee should increase. The Clerk will gather prior year Certified Mailing total charges and other pertinent details to support any increase. The cost of Certified Mail/Return Receipt has increased over the years, and invoice charge remained the same. Postage is to go up again the end of April.
Ø  Village will sponsor the Memorial Day Parade 2015.
Ø  A speed limit sign request from Elm Street will be forwarded to DPW.

Mayor Frohne – Budget discussion and new DPW position. Motion to advertise for estimates on painting the Library walls and ceilings by Trustee Leonard, 2nd by Trustee Walsh – all voted yes.

Motion to approve Part I of the Full Environment Impact Assessment by Trustee Moshier, 2nd by Trustee Leonard. Motion to approve Part II by Trustee Leonard, 2nd by Trustee Moshier. Motion to approve Part III by Trustee Hazelton, 2nd by Trustee Moshier. All voted yes on all three motions.
  
RESOLUTION AUTHORIZING THE ADOPTION OF A FINDING OF NO SIGNIFICANT IMPACT

WHEREAS, the Village Board introduced proposed Local Law amending Village Code §275-12 A. (2) entitled: “A Local Law Amending Chapter 275, Entitled ‘Zoning’ of the Code of the Village of Richfield Springs to Allow for Convenience Stores with Fuel Pumps in the B-1 Business District” which regulations shall apply to all B-1 and B-2 Districts; and

WHEREAS, the State Environmental Quality Review Act (SEQRA) regulations found at 6 NYCRR Part 617.3(a) requires that no agency shall carry out, fund, or approve an action until it has complied with the requirements of SEQRA; and

WHEREAS, 6 NYCRR 617.6(a) requires for approval of an action it must:  (1) determine whether the action is subject to SEQRA, (2) determine whether the action involves a federal agency, (3) determine whether other agencies are involved, (4) make a preliminary classification of the action, (5) determine whether a short or full EAF will be used to deter­mine the significance of the action; and

WHEREAS the Board is declared as lead agency with respect to SEQRA review of proposed action, and;

WHEREAS, the Board determined that in accordance with NYSCRR Part 617.4(b) (10) that the action is classified as a Type 1 action; and

WHEREAS, concluded in the Part 3 EAF and the Negative Declaration that the project will not result in any significant adverse impacts as defined by SEQRA; and

THEREFORE, BE IT RESOLVED the Village Board adopts a Negative Declaration for the proposed action as described in the Part 3 Full Environmental Assessment Form.

Motion to adopt Resolution by Trustee Hazelton, 2nd by Trustee Moshier – all voted yes.

The Village Clerk will refer to Otsego County Planning Department, per General Municipal Law.
Motion to put ad in paper(s) for Public Hearing on Local Law 1-2015 at the next meeting on April 29, 2015 by Trustee Leonard, 2nd by Trustee Walsh – all voted yes.

Trustee Hazelton – The library Board members will continue to clean Memorial Room.

Trustee Moshier – Village Office received two quotes for website revival and would like to see this proceed along with updating versions of Microsoft Office for each computer for compatibility.

Trustee Leonard – Boy Scout meeting room has safety issues he would like addressed.

Motion to adjourn meeting at 8:17pm by Trustee Moshier, 2nd by Trustee Leonard – all voted yes.
