Present:

Meeting called to order at 6:00pm by Mayor Frohne, followed by the Pledge of Allegiance.

Property Maintenance report. Motion to declare the following property a public nuisance and authorize remediation pursuant to Property Maintenance Code § 207-9 of Village Code by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes:  20 Lake Street

Dog Control Officer – Mark Yerdon reported minimal activity for last month.

Fire Chief – Tom Hallock reported on the necessary repairs to the fire truck. Also inquired about Fire Department Contracts and fuel bids. Motion to approve going with the County Bid awards for fuels by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes.

Motion to waive the reading of and to approve the meeting minutes from 11/26/2014 by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes except Trustee Patrick, who abstained.

Ø  Abstract #13 Funds: General $16,570.69, Water $2194.05, Sewer $6120.52, Cemetery $133.69; total: $25,018.95. Motion to approve Abstract #13 by Trustee Leonard, 2nd by Trustee Moshier – all voted yes except Trustee Patrick, who abstained.
Ø  Motion to approve amendment to Abstract #12 reflecting the corrected distribution of the NYS & Local Retirement System expenditure ($50,792.00) among the funds as follows:  A - $28,085.74; L - $3,277.00; G - $13,090.93; and FX - $6,338.33 by Trustee Moshier, 2nd by Trustee Leonard – all voted yes except Trustee Patrick, who abstained. 
Ø  Motion to approve Town Hall for March 18, 2015 Annual Election venue with polls open from noon-9pm by Leonard, 2nd by Trustee Moshier – all voted yes.
Ø  Motion to approve Ann Owens and Richard Harris as 2015 Annual Village Election Inspectors at $12/hr by Trustee Leonard, 2nd by Trustee Moshier – all voted yes except Trustee Patrick, who voted no.
Ø  Motion to hold next meeting on December 30th at noon by Trustee Leonard, 2nd by Trustee Moshier – all voted yes.
Ø  Property maintenance check received on 35 James Street totaling $8652.29 which includes all outstanding fees and interest against that property, to date.
Ø  Computel report for TWC filed in office.
Ø  Clerk to look into ESCO suppliers.
Ø  Attorney Merzig had no issues with legal form and content of the Lamont proposal for fountain repair.
Ø  Motion to approve Tom Shypski and Chris Butler to attend NYWEA class on 12/11/14 for $31/each by Trustee Leonard, 2nd by Trustee Patrick – all voted yes.
Ø  The November 2014 Fire Department Report filed with the Clerk.

Deputy Clerk/Treasurer – Harriett Geywits

Ø  Followed up with the Board on Lamont’s proposal.

Ø  Treasurer notes submitted. States the Annual Update Document was filed on December 3, 2014.

Mayor Frohne – Discussion on restructuring the departments to better utilize work flow, following notice of Tom Shypski’s retirement at the end of the year.

Trustee Moshier – Would like to compare liability insurance rates with local agents, for best practices. Discussion on Kwik Fil station followed.

Trustee Leonard – WTP has generator quote will be sent to Village office fax. More discussion on Tom Shypski’s benefits post retirement.

Trustee Hazelton – Complimented the Garden Club and DPW for the Christmas adornment displayed in Spring Park and through the Village.

Trustee Patrick – Followed up on previous meeting issues.

Meeting called to order at 6:00pm by Mayor Frohne, followed by the Pledge of Allegiance.

Melinda Harrington, property maintenance manager for Kinney Drugs, addressed the Board regarding the ‘Order to Remedy’ notice received by property owner both on 6/20 & 10/29. Discussion followed.

DPW Superintendent William Collins – Reported to the Board on Barrett’s street paving. He is not completely satisfied with their work and will file a report in the Village Office.

Motion to waive the reading of and to approve the meeting minutes from 11/11/2014 by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.

Clerk – Dayle Barra

Ø  Abstract #12 Funds: General $79,801.36, Water $31,072.99, Sewer $3198.71, Cemetery $2904.42, Trust & Agency $82.64; total: $117,060.12. Motion to approve Abstract #12 by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes.
Ø  Boy Scouts will hold their annual Christmas Tree Sale in the Library parking lot.
Ø  Motion to approve the Lion’s Club Spring Park application foregoing the deposit by Trustee Leonard, 2nd by Trustee Moshier – all voted yes.
Ø  A bill for $150 was received by Clerk from Edwards Ambulance. Clerk inquired with Attorney Merzig who confirmed the Village is not legally liable to pay this bill. At the suggestion of the Attorney, the bill was sealed and filed due to the enclosure of personal health information.
Ø  A tenant filed a pool-fill application requesting the sewer discount for their jacuzzi fill. The Board said no discount on such is permitted.
Ø   Lamont Engineers proposal to be forwarded to the Village Attorney for his review and comment.
Ø  The October 2014 Fire Department Report is filed with the Clerk.

Mayor Frohne – Department Meeting was held this morning and discussion followed. Motion to adopt the following resolution by Trustee Moshier, 2nd by Trustee Leonard – all voted yes.

Resolved, for current employees eligible to receive health insurance benefits, who have reached the age of 65 and opted to switch to Medicare Parts B & C, and who also receive benefits for a spouse, the Village will cover the full cost of the employees insurance, not to exceed that paid on behalf of other full-time employees receiving single coverage; the Village will cover the cost of their spouse’s Medicare insurance up to $200. For the current insurance period running from January 1, 2015 to December 31, 2015. The cost of employees insurance is defined as the monthly premium.

Trustee Leonard – WTP has generator issues which maintenance contracts does not cover. Trustee Leonard asked Mr. Shypski to get a repair estimate, which he was not given.

Trustee Moshier – A canceled check audit was performed by Trustee Moshier.

Property Maintenance Hearing
Keith Sterling, ZEO, gave his report to the Board. Motion to declare the following properties a public nuisance and authorize remediation pursuant to Property Maintenance Code § 207-9 of Village Code by Trustee Moshier, 2nd by Trustee Leonard – all voted yes:

Wayne’s Welding submitted a bid on the one-way plow, as advertised, for a total of $40,068.00. DPW Superintendent William Collins will look that over.

Ø  Abstract #11 Funds: General $13,010.70, Water $1635.24, Sewer $7564.24, Cemetery $26,249.95; Total: $48,460.13. Motion to approve Abstract #11 by Trustee Leonard, 2nd by Trustee Moshier – all voted yes except Trustee Patrick; who abstained.
Ø  October 2014 fees clerk collected $46.50.
Ø  Property Tax Collection, to date, $537,803.35.

WHEREAS, Article 14, Section 1436, Paragraph 2 of Real Property Tax Law authorizes village tax collectors to return to its respective County Treasurer a listing of unpaid taxes for enforcement, and
WHEREAS, the Village of Richfield Springs total property tax collection totaled $537,803.35 for 2014-2015 taxes with an outstanding balance of $55,312.58 on 61 properties together with penalties and fees totaling $63,919.23, therefore
BE IT RESOLVED, the village tax collector, in accordance with Real Property Tax Law, is returning to Otsego County Treasurer’s Office the 2014-2015 unpaid Village Tax accounts for further collection with certification of the Board of Trustees and hereby accepted.

Motion to adopt resolution by Trustee Moshier, 2nd by Trustee Leonard, all voted yes.

Ø  Petty cash totaling $200 for tax collection purposes returned to Treasurer for deposit.
Ø  W/S billing was discussed together with Richfield LLC (Price Chopper Plaza) holding 7 accounts in tenant’s name. Ultimately, all charges are for property owner per Village Code 260-7 (G).
Ø  Boy Scout Troop 14 spent a day picking up trash at Allen Lake Reservoir due to the overwhelming amount of litter. The Board expressed their gratitude.
Ø  Lamont Engineers submitted a draft Fountain Proposal for the repair.
Ø  Comprehensive Planning Committee Meeting minutes from 9/15/14 filed in the Office.
Ø  Report submitted to Trustees from Harriett Geywits, Deputy Clerk/Treasurer.

Mayor Frohne – Submitted Corrective Action Plan for Justice audit response. Discussed the possibility of appointing a Public Health Officer.

Trustee Leonard – WTP has generator issues. The Clerk will confirm whether there is an existing maintenance contract in place, which she suspects it the case.

Trustee Moshier – Peeled glued signs from telephone pole near Post Office while restating possibly implementing sign permits. Discussion followed. Would like to know where Village residents stand in whether to repair Ann Street bridge or not.

Mr. Juteau reported nothing has been done with his neighbor with the rat situation, as the County referred the matter to Adult Protective Services.

Mr. House submitted a letter to the Mayor. The Mayor requested the Clerk make copies for the Board and file, accordingly.

Ø  Motion to return all unpaid property taxes to Otsego County by November 7th by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.
Ø  Trooper Barrack’s received approval from the State to proceed with generator request from last year. They will submit request with current estimates and terms.
Ø  RSCS sent letter to Board informing them of possible School-based Health Center on campus.
Ø  Treasurer audit performed on 10/28. Reports to follow.

Ø  Updates to the Board, including the Clock repair done by Ken’s Clocks and paid for by Mr. Larry Jouben. The Board expressed their gratitude.

Mayor Frohne – Shared the draft Corrective Action Plan to be submitted in response to the Justice Audit. Discussed the estimate of $2000.00 to repair WTP truck parking break submitted by Tom Shypski. Procurement Policy states two estimates are required. The Board will compare estimates when made available to them.

Trustee Moshier – Asked Bill Collins about the status of the Main Street water line leak. Bill confirmed this had been corrected.

Trustee Patrick – DPW will look into providing a secondary water line in the spring for use by the Garden Club in Spring Park.

DPW Superintendent Bill Collins – Motion to authorize bid advertising for new plow and changeover spreader and wing by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.
The Mayor inquired about the water leak at Lucille Coppola property on 263 Main Street. The Mayor will follow up on this matter.

Fire Chief Tom Hallock – Radio system will be replaced and housed at the Water Treatment Plant. No grant from FEMA this year.

Senior Department Head Chris Butler – Updates to the Board. Suggests sludge rate be increased to $.10/gal in the coming new year.

Ø  Motion to approve purchase of John Deere lawn tractor for Cemetery for $2912.46 per quote as submitted by Bryan Coones by Trustee Moshier, 2nd by Trustee Patrick – all voted yes.

DPW Superintendent Bill Collins – Motion to authorize AJ VanTassel, Doug Bordinger, and Bill Collins to attend the Water Operator’s Certification course, as required by NYS Sanitary Code Part 5, October 15 & 16th for $325 each by Trustee Leonard, 2nd by Trustee Moshier – all voted yes. The culvert piping was placed on Cary Park Road to remedy the storm water drain issues as previously reported. Discussed with the Board the email from Mr. Brykailo on a new tap at Monticello Street property. The work would be very costly for to him to complete. Bill will relay this to him, accordingly.

Fire Chief Tom Hallock – The Advanced Life Support certification for Mr. Les Olmstead will expire and two other members are interested in obtaining their certification. FD roof was patched.

Mr. Duane Pierson asked for clarification on the ad placed in the Pennysaver. The ad was to alert residents that when private work is to be done by homeowners or contractors where streets, sidewalks, or village property could be obstructed, such as tree removal, the village office must be notified to ensure safety measures are followed according to Village Code. Other external work may require contacting the Village Office prior to commencement, as well.

Street Paving Bids
Motion to award bid to Barrett Paving Materials, Inc. for an amount of $20,154.28 per their submitted bid dated 9/24/2014 by Trustee Leonard, 2nd by Trustee Moshier – all voted yes. Hanson Aggregates NY LLC also bid at $23,760.00.

Ø  In light of the ensuing Treasurer audit the CPA firm has discovered the necessity for some preliminary changes to financial accounting as a prerequisite to the audit. Motion to authorize the payment of $1500 for the additional work as outlined in Tony Mostert email dated 9/23/2014 by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.
Ø  Motion to offer an employee turning 65 years old the option to switch to Medicare Parts B & C with the Village contributing an amount not to exceed that paid on behalf of other full-time employees receiving single coverage by Trustee Moshier, 2nd by Trustee Leonard – all voted yes.
Ø  August 2014 Profit & Loss and Balance Sheet distributed.

Deputy Clerk/Treasurer – Harriett Geywits

Ø  Undertaking project plans for Spring Park Fountain.
Ø  Submitted estimates for new tractor for Cemetery Sexton. The Board asked it be tabled for the time being.

Ø  Property Tax Collection, to date, $523,349.94.
Ø  At the request of an applicant for Spring Park use, the Board was requested to look into whether or not it is feasible to reduce limits of liability insurance needed for non-fundraising applicant leasing the premises for private parties.
Ø  To maintain the aesthetics of Spring Park, no signage shall be posted on the grounds.
Ø  Lamont Engineers sent a letter expressing their interest in assisting the Village with future engineering services.
Ø  Trick or Treat will be Friday, October 31st from 6-8pm.
Ø  Comprehensive Planning Committee meeting minutes from 9/15/14 on file.
Ø  Fire Department Report August 2014 on file.

ZEO report to Board members.

Diane Yaciuk of Main Street will have her daughter’s family and two dogs temporarily stay in one apartment of the duplex home they own while their home is being built on the adjacent lot. The Yaciuk’s have one dog. The Board will allow more than two dogs to be harbored there temporarily due to the situation as presented to them.

DPW Superintendent Bill Collins – Motion to authorize purchase of Smith Series sander for $5252 per estimate submitted 7/9/2014 by Trustee Leonard, 2nd by Trustee Moshier – all voted yes.

Deputy Clerk/Treasurer – Harriett Geywits

     Motion to award Josh’s Tree Service the Lakeview Cemetery tree care project at a total bid price of $25,900.00 as outlined in his proposal dated August 24, 2014 by Trustee Leonard, 2nd by Trustee Moshier – all voted yes.
     Residents have complimented on the beautifully maintained grounds and the nice job Cherry Valley Memorials did on the monument repairs throughout.

Clerk – Dayle Barra

     Abstract #7 Funds: General $36,069.51 Water $3581.01, Sewer $6221.14, Cemetery $2427.03, Trust & Agency $82.64; Total: $48,381.33. Motion to approve Abstract #7 by Trustee Moshier, 2nd by Trustee Leonard – all voted yes.
     August 2014 Clerk fees $40.00.
     Property Tax Collection, to date, $518,476.31.
     Motion to pay dental insurance of $45.60/mo. for Chris Butler by Hazelton, 2nd by Trustee Leonard – all voted yes.
     There is an energy Audit workshop being held next month at Town Hall for interested parties. The clerk has more information available.
     County Codes Officer, Neal McManus, contacted the Clerk regarding updating the concern of an elderly neighbor with a rat infestation as reported by a Mr. Juteau of Johnson Street. The matter is being referred to Adult Protective Services. Mr. Juteau was forwarded this information.
     Motion to increase 2015 Fire Contracts with Town of Richfield, Warren, and Schuyler Lake by 2% for next year by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.
    The Board needs to make health insurance decisions on employees who continue to be employed upon reaching 65 years of age.
     Treasurer noted Columbia Property Trust interest is $804.30 per quarter.

Mayor Frohne – Mr. Frank Novak, with McManus Engineering, suggested the ditches on Cary Road be dug out more, as a first step to remedy water flow issues. DPW will look into it.

Trustee Patrick – With the recent growing numbers of contractors working in the area to remove trees, it be essential certain regulations are in place, particularly safety of village residents along with contractor liability insurance. Measures were discussed with the Board and Bill Collins to ensure the measures are met. An ad will go in the Pennysaver advising residents Village Code may play a role in these scenarios and to check with the Office. Motion to place ad in Pennysaver regarding contractor-initiated work in the Village by Trustee Moshier, 2nd by Trustee Patrick – all voted yes.

Trustee Moshier – Motion to hire Mostert, Manzanero, & Scott, LLP to audit Treasurer Books not to exceed $4000 as outlined by their proposal by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes except Trustee Moshier, who abstained.

Motion to adjourn meeting at 8:05pm made by Trustee Patrick, 2nd by Trustee Moshier – all voted yes.
