BOARD OF TRUSTEES MEETING
MINUTES AND ORDER OF BUSINESS

July 8, 2014 in the Public Library Memorial Room.

Present:
Elected Officers - Mayor Ronald A. Frohne II, Trustee Raymond Patrick, Trustee Robin Moshier,
Trustee Frances Hazelton and Trustee Warren Leonard

Appointed Officers - Dayle A. Barra, Clerk, and Harriett Geywits, Deputy Clerk/Treasurer

Meeting called to order at 6pm by Mayor Frohne, followed by the Pledge of Allegiance.

Property Maintenance Hearing

Motion to declare the following properties a public nuisance and authorize remediation pursuant to Property Maintenance Code § 207-9 of Village Code by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes:

18 Lakeview Ave          11 Church Street

Motion to deem tree downed on house at 35 W James Street a safety hazard and order immediate remediation, doing the minimum to make safe pursuant to Property Maintenance Code §207-10 by Trustee Moshier, 2nd by Trustee Leonard – all voted yes.

Zoning Enforcement Officer – Keith Sterling gave his report to the Board. Motion to approve ZEO attending NYS DOS Code Enforcement Basic Training Program August 19-21 by Trustee Leonard, 2nd by Trustee Hazelton – all voted yes. Motion to approve meal allowance during the training not to exceed $30/day by Trustee Leonard, 2nd by Trustee Moshier – all voted yes.

DPW Superintendent – Bill Collins informed the Board the need to grind the brush pile as it is too large to burn. Motion to advertise for this service by Trustee Leonard, 2nd b Trustee Hazelton – all voted yes.

Fire Chief – Tom Hallock discussed the air tanks as outlined in quote from MES. In light of the weather, the Fire Department responded to 35 calls over the weekend.

Trustee Moshier excused herself from the meeting at this time (7:09).

Mr. John Nicolosi informed the Board of a sewage leak inside a backroom of his home and inquired whether the Village carried insurance for homeowner issues. The Board inquired further details and will discuss with pertinent staff to ascertain the situation.

Motion to waive the reading of and to approve the meeting minutes of 6/25/2014 by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes.

Trustee Moshier returned at this time.

Clerk – Dayle Barra

     Abstract #3 Funds: General $6944.34 Water $3910.70 Sewer $4552.73, Cemetery $612.54; Total: $16,020.35. Motion to approve Abstract #3 by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.
     Clerk’s report for June 2014 total fees taken in $90.
     Total property tax collection, to date, $491,612.32.
     In light of the recent w/s software issues it was discovered many homes have broken meters that need to be replaced. The Board asked work orders be done for them.


     Motion to acknowledge Vet’s Club 30-day Notice of Renewal for their liquor license with no objections by Trustee Leonard, 2nd by Trustee Hazelton – all voted yes.
     Motion to approve w/s adjustments by signing off by Mayor and one (1) Trustee by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes.
     Motion to approve Spring Park application for graduation picnic 7/19 from 12-4pm waiving fees for employee who will open and close park in lieu of pay by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.

     In the past few years we have discovered that deed purchases in that certain Cemetery section during an indefinite time period were not properly recorded.   This resulted in an occasional issuance of duplicate deeds.  This recording error should straighten itself out given enough time.  Until it can be certain that deeds will not be re-issued (many years), no new lots will be sold in this section.
     Jim Warren, State representative of NYS Parks Service and other key people met with Harriett to discuss plans to repair the fountain. A report was given.

Mayor Frohne – Discussed plan for tree removal around the Village. Board decided to retrieve the truck from Skinner's, purchase the parts necessary, and get the necessary repair work completed.

Motion for Chris Butler to become Senior Department Head with an annual stipend of $500 by Trustee Leonard, 2nd by Trustee Moshier – all voted yes except Trustee Patrick, who voted no.

Trustee Leonard – Motion to provide cell phones to Chris Butler, Bill Collins, Tom Shypski, and the ambulance under contract plan for $60/month to be used by personnel after hours for work-related phone calls by Trustee Leonard, 2nd by Trustee Hazelton – all voted yes.

Motion to pay Jim Malinowski full salary pay of 48 unused sick days by Trustee Leonard, 2nd by Trustee Moshier – Trustees Hazelton, Moshier, Patrick and Mayor Frohne all voted no. Motion not carried.

Motion to pay Jim Malinowski $50/day for 48 unused sick days by Trustee Moshier, 2nd by Trustee Hazelton. Trustees Leonard and Patrick voted no. Trustees Hazelton, Moshier and Mayor Frohne voted yes. Motion carried.

Trustee Hazelton – Asked about the options for making Library front door easier to open. It is very heavy and difficult for the elderly and children to open. Discussion followed.

Trustee Moshier – Concerned the Richfield Springs Central School doesn’t understand the need to go through proper Village Code channels before proceeding with the propane filling station plan. She attended a meeting in the capacity of Village Trustee to offer that information. A formal letter will be sent to the Superintendent Myers and the School Board.

Present:

Meeting called to order at 6pm by Mayor Frohne, followed by the Pledge of Allegiance.

Property Maintenance Hearing

Katherin Cline and neighbor John Grampp spoke to the Board concerning property issues. Mr. Grampp intends to put structures on his property and remove some trees, while Ms. Cline is concerned about potential damage to her property in removing trees. Mr. Sterling, ZEO, has an application on file for the local zoning permit and upon his return and decision, the matter will be addressed, if necessary.

Motion to declare the following properties a public nuisance and authorize remediation pursuant to Property Maintenance Code § 207-9 of Village Code by Trustee Moshier, 2nd by Trustee Leonard – all voted yes:

Trustee Leonard expressed concerns over the LLC mowing invoices. He feels they are excessive. The Board recommends we get estimates prior to outsourcing the jobs. The Clerk will do so.

Zoning Enforcement Officer – Keith Sterling gave his report to the Board.
DPW Superintendent – Bill Collins updated the Board on items being dealt with.

Bill Juteau had comments and questions, one of which was a request to cease the requirement to bag debris for pick up by DPW Monday mornings. DPW Superintendent Bill Collins agreed this to be doable. Motion to eliminate the plastic bag requirement for yard debris and allow debris to be piled or in paper bags by Trustee Patrick, 2nd by Trustee Leonard – all voted yes.

Bill Collins also updated the Board on replacing the roof on the bathrooms in Spring Park as well as the swing that rotted over the winter.

Chris Butler reported to the Board the improved storage pond size project they have been working with DPW on, rather than enlisting outside resources.

Motion to waive the reading of and to approve the meeting minutes of 6/10/2014 by Trustee Moshier, 2nd by Trustee Leonard – all voted yes, except Trustee Hazelton, who abstained.

Clerk – Dayle Barra

     Abstract #2 Funds: General $7547.16 Water $1233.53 Sewer $2818.23, Cemetery $267.92, Trust & Agency 206.60; Total: $12,073.44. Motion to approve Abstract #2 by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.
     Motion to approve Demolition Permit 2014-10 as submitted by SMP Richfield Springs LLC with Clerk’s acceptance of Cash deposit $20,000.00 in lieu of Surety Bond authorizing Treasurer to deposit in the General Fund account by Trustee Leonard, 2nd by Trustee Patrick – all voted yes.
►    Motion to authorize the purchase of roses for Spring Park clock area up to $380 by Trustee Moshier, 2nd by Trustee Hazelton – all voted yes.
     Motion to approve refund to Darrell Decker for $114.93 representing April penalties and the relevy fee for erroneous water/sewer bill from March 2014 and did not receive a new bill as indicated at that time by Trustee Hazelton, 2nd by Trustee Leonard – all voted yes.
     It’s apparent there is no ideal location for the bicycle rack in Spring Park and they will let the Eagle Scouts proceed in another direction, as they indicated being an option.
     Profit & Loss and Balance sheet to the Board.

Deputy Clerk/Treasurer – Harriett Geywits

     Informed the Board she has enlisted the aid of Marjorie Walter’s and she offered contact Jim Warren, State representative for Historical Districts, for information leading to the reservoir fountain. The Board agreed it would be a good starting point.
     Updated the Board on Lakeview Cemetery monument repairs and will proceed with Superintendent Bill Collins going up there to assess the repair of one to see all that may be involved.

Trustee Hazelton – Would like to proceed with staining and fixing Library front door.

Trustee Moshier – Otsego Biomass Project discussion along with RSCS propane filling station. Asked Harriett Geywits if she would be interested in being appointed Village Historian to be discussed at a later date.

Trustee Patrick – Wondered the status of Spring Park sign.

Trustee Leonard – Inquired about department heads needing/wanting business cell phones and followed up with Jim Malinowski sick pay status. The Mayor will contact the village attorney.

Motion to adjourn meeting at 7:54pm made by Trustee Patrick, 2nd by Trustee Leonard – all voted yes.
